APCL - Totals tildeling av ROP er under kritikk

Det ser ikke ut til at Totals tildeling har gått redelig for seg. Som tidligere kjent så nektet oljeministeren å signere avtalen og ble etter dette sparket.
Ser også at gode gamle Frank Timis ikke forsvinner selv om han er borte fra selskapet.

Investor confidence in Senegal as an offshore destination was knocked back this week when President Macky Sall’s former energy minister Thierno Alasanne Sall chose the eve of an international oil conference to broadside the presidency over mismanagement of natural resources, writes Barry Morgan.

Thierno Sall condemned the manner in which several industrial awards had been made, specifying the allocation of two sought-after blocks, the St Louis Deep and Cayar Deep, to the little known exploration vehicle PetroTim, which he described as “the biggest scandal in the history of Senegal”.

The son of a former Imam at the Grand Mosque in Grand Thies, Thierno Sall this month declared himself as the presidential candidate for his Republic of Values movement and has campaigned on a ticket of transparency.

Thierno Sall urged the declassification of government reports commissioned to investigate if malfeasance had taken place, and promised to provide further evidence himself if so required.

The former minister referenced the subsequent acquisition of title to these and other blocks in which vehicles associated with Romanian-Australian magnate Frank Timis and his partners enjoyed a controlling share — equity that was later much reduced.

Thierno Sall insisted procedural safeguards under local administrative law had been breached, castigating President Sall for ruling by decree and causing potential loss to the state running into billions of dollars.

The opaque antecedents surrounding title to some of Senegal’s most prized offshore acreage has deterred some players from entering the play — Australian independent Woodside Petroleum demurred before giving up on the Rufisque Deep, where Total eventually took on operatorship from Oslo-listed African Petroleum.

Thierno Sall last year refused to sign off the Rufisque acreage with Total and was promptly sacked.

However, the big players then moved in without apparent concern, notably UK supermajor BP, French major Total, US independent Kosmos Energy and Malaysian state player Petronas, effectively wiping the slate clean for other majors companies to take on equity.

Jeg synes det er modig gjort av Thierno Sall. Hadde dette vært i en del andre afrikanske land eller i land som Saudi eller N-Korea hadde han vært forsvunnet fra Jorden overflate nå.

Dette er en kar med større ambisjoner og han ser nok sitt snitt nå til å fremstå som redelig i et land hvor mye ikke er det. Nå er han presidentkandidat og da passer det også med sverting av den andre siden. Vi får se hvor mye mer som kommer og ikke minst om det kan ha noe å si for oss.

Men når en tidligere minister trekker frem misligheter ved tildeling av lisenser, endog misligheter som kan ha kostet Senegal "billions of dollar", da trekker du på skuldrene og skriver "so what"

Det er vel også et faktum at APCL ikke overholdt sine forpliktelser og at dette kan ha kostet milliarder dollar. Og hvem vet, det kan vel være at tildelinger tidligere med denne Timis ikke har vært helt renhårige. Hvilken rolle Sall har hatt tidligere, vet ikke jeg så mye om. Men folk som får sparken, sparker ofte tilbake hvis de kan, for å si det sånn.
Jeg vet ikke, men for å være ærlig tror jeg ingen store reelle endringer i kursen skjer før det avklares utfallet av voldgiftssakene.

Ikke godt å si hva årsaken kan være. Vi vet jo fra før at det kanskje er litt tette bånd til saksbehandler i Gambia saken. Det kan være noe her. Uansett ikke noen ytterligere info tilgjengelig som jeg kan se og da blir det bare spekulasjoner.

Merk altså at alle relevante aktører er på den store oljekonferansen i Senegal som går fra onsdag og avsluttes i dag. Her er BP, Exxon, Total, Shell, FAR, Kosmos, Woodside, Cairn mm, de senegalesiske oljemyndigheter er der og det er også det gambiske oljeministeriet. Senegal har jo også bedt om foreløpig interesse på SOSP (som APCL hevder å ha rett til) med frist siste oktober så det er nok å snakke om.
Og ja, African Petroleum står på deltagerlisten.

Jeg følger med på aksjen dels fordi jeg vant et veddemål om apcl men ikke fikk premien.Jeg håper at det går veien. Liker ikke at folk taper penger, men liker heller ikke at folk blir narret inn aksje på falske premisser.

Mamadou Ndione answers all questions about oil and gas in Senegal

Mamadou Ndione posted on his Facebook page a statement that highlights the issue of oil and gas in Senegal. The economist specializing in port and logistics issues, including the Director-General of the Senegalese Chargers Council (COSEC), addressed the question in the form of a presentation, using questions and answers.
In the light of the resumption of vain attempts at misinformation on oil, it is urgent to help the public to better understand in a simple simple question-answer style.

1- What research contract binds Senegal to multinational hydrocarbons?

On the basis of Law 98-05 of 8 January 1998 on the petroleum code, the Government of Senegal through Petrosen has drawn up a "standard contract for the research and sharing of hydrocarbon production".
The provisions of this model contract are the same for all companies that want to do research in Senegal. The much-maligned contracts of Timis had been signed under the old regime.
Senegal does not discriminate. Companies from all over the world who provide technical and financial guarantees can come to sign contracts, do their own research and share with us in case of discovery. This is the case of the fifteen or so companies of all nationalities doing research.

2- What should the company pay during the research and development phase?

These companies investing in research take a risk. If they find, we share. If they do not find they lose.

Therefore, they do not pay taxes in accordance with Article 48 of the Petroleum Code which says: "The holders of agreements or service contracts and the companies associated with them under the protocols or agreements referred to in Article 8, paragraph 4 are exempted during the research and development phases; of all taxes, duties and taxes for the benefit of the State ".

To strengthen this system, Article 722 of the General Tax Code says: "Persons admitted, either for the benefit of the investment code, or for the benefit of the laws relating to export-free enterprises or to companies approved in the industrial free zone. of Dakar or laws relating to mining and petroleum codes, remain subject, for the duration and the validity of their authorization, to the tax system which was granted to them according to the texts in force, on the date of this approval ".

During research and development, these companies pay only the Surface Taxes, the training and promotion costs of the basin, the symbolic signing bonus of US $ 500,000 payable once and paid to Petrosen and the Social Funds of 150,000 US $ / year.

When the operation begins, they are subject after recovery of investments to the same rules of payment of taxes as any conventional business of which 25% in respect of corporation tax.

From 1952 to 2014, 168 boreholes were completed with a cost exceeding 500 billion FCFA with little success.

3- Do the companies signatories of research and production sharing contracts have the right to sell their shares?

They can do this in accordance with Article 56 of the Petroleum Code which states: "Mineral oil titles, agreements or service contracts are transferable and transferable, subject to prior authorization, to persons with technical capabilities. and financial resources to carry out oil operations ".

The misinformers dwell on the transfers made by Timis to Kosmos and recently to BP. Why these same misinformers never speak of the disposals made on the Sangomar Offshore block where the company Hunt Oil signed the departure made to the Australian group Far which then expanded to Cairn Energy and Conoco Philipps.
The misinformers do not talk about it because they are in a debate of innuendo to sow doubt with false allusions.
Tomorrow other majors will join the business of exploration and research without paying additional taxes during research and development as it is practiced almost everywhere in the countries in the exploration phase using the model "contract of research and sharing production "!

4- Are companies exploiting our oil and gas?

Not yet on the most important deposits. The most optimistic forecasts speak of the year 2021 with the Saint-Louis Offshore gas block.

5- What will Senegal gain in oil and gas?

Senegal may eventually have 80% of its oil and gas revenues after recovery of investments. That if we base ourselves on:

- the 10 to 20% of Petrosen,
- the shares of Senegal between 35 and 58% in a range between zero to 120,000 barrels / day in accordance with signed contracts
- the 25% of corporate taxes when the holding will start
- taxes on wages and the like,
That not counting the tens (even hundreds) of thousands of jobs to create.

6- What has been planned for the use of our oil and gas revenues?

We are fortunate to have one of the best oil and gas experts in the country at the helm of the state. President Macky Sall made the following decisions:

A- Accession since 2013 to the EITI Extractive Industries Transparency Initiative process with cross-reporting requirements for revenue from these resources.

B- The setting up of the Strategic Orientation Committee on Petrogas Oil and Gas COS.

C- The launch of the National Institute of Oil and Gas.

D- For a better use of the future resources, there will be a law of orientation with a wide consultation of all the public, private, political and civil society actors to agree on a key of distribution between the budgets of investment and operating and the share reserved for future generations through a housing Sovereign Fund for Strategic Investments.

These decisions are part of a desire to make rational use of these important additional revenues which should not make us give up in other sectors of economic life.

In the end, on oil and gas, we must stay in the truth and avoid this heated debate. May this short text help the citizen to see only the truth.

Dette indikerer vel bare at det er engasjement i Senegal.
Også interessant å lese kommentarene til denne på FB der den ble lagt ut.

Når Timis nevnes, så er det bare i form av de lisenser som ble solgt,- Ikke noe negativt om APCL. Dette å lese mellom linjene, er noe å hente på.

Det står innledningsvis at dette er en ny posting av en artikkel skrevet i 2017. (!)

Da er vel kanskje ikke teksten like relevant nå. Det har jo ikke vært helt samsvar mellom liv og lære. (ROP til Total, for eks), og hele petroleumspolitikken i Senegal er vel under oppdatering nå, slik jeg har forstått det.
