A statement released on behalf of members of a group that requests tariffs be levied against a handful of Chinese-based solar manufacturers said they were “disappointed” by a Commerce Department decision to reject its petitions. This occurred after the group held firm in its decision to keep its makeup hidden from the public.

“We strongly disagree with Commerce’s rationale for denying proprietary treatment of our identities,” the group said through its law firm, Washington, D.C. based Wiley Rein. It said the government is “well aware of the real risk of retaliation” that members of American Solar Manufacturers Against Chinese Circumvention (A-SMACC) face from the Chinese government and Chinese competitors. “It is unfortunate that we are being forced to choose between revealing our identities and exercising our trade remedy rights.”

The group said it is “evaluating all options,” including refiling an anti-dumping (AD), anti-circumvention (CVD) petition that would satisfy Commerce Department concerns.

In a November 10 decision, Abdelali Elouaradia, director of the Commerce Department’s AD-CVD office, said that A-SMACC’s insistence to keep the names of its member companies from the public would “prevent Commerce from obtaining and considering” information related to an inquiry.

Elouaradia wrote that “not disclosing A-SMACC members’ names publicly hampers interested parties from fully commenting on the requests for circumvention inquiries and may hamper them from commenting on certain issues that could arise if Commerce were to initiate circumvention inquiries.”

The Commerce Department said Nov. 10 that treating the names of A-SMACC's members as business proprietary information is unwarranted and could hinder a government investigation. The government delayed ruling on the petitions in September as it sought the names of A-SMACC's members.

"In order for all interested parties to comment fully on these requests for circumvention inquiries ... we have determined that the names of A-SMACC's members should be publicly identified," the department said in its ruling.

In an email to pv magazine in October, Timothy Brightbill, an attorney with the Wiley Rein law firm that represents A-SMACC, said that the decline in module imports to the U.S. during the third quarter has been “most pronounced from Malaysia” with the decline beginning in July, and accelerating in August. He said that the A-SMACC petitions were filed on August 16 and that the drop in imports appeared to correspond with the “wide reports that that Customs and Border Protection had detained major solar import shipments.”

He said that imports from Thailand and Vietnam started to fall “sharply” in June and July.

Så er der gået 20 dage siden Wiley Law indsendte det efterspugte information til DOC (Department of Commerce).

Sidste gang tog det 44 dage for DOC at svare, fra Wiley Law indsendte første petition d. 16 august.

Svar fra DOC kom d. 29 september, hvor DOC efterspurgte yderligere information. Dette genstarter de 45 dage, som er tidsfristen for svar fra DOC.

Så indenfor de næste 24 dage dvs. fredag d. 26. November, (da d. 27 er en lørdag) kan vi forvente et eller andet fra DOC vedr. dette.

Er det KUN disse kinesiske firmaer som tariffen kommer til at være berørt af tarifferne. Dette sker først EFTER en undersøgelse ind i hvorvidt det overhovedet bryder loven!

SEIA's statements er tåbelige. Det skinner klart igennem at der jobbes for egne interesser og for at opretholde status quo. Hos dem er der ikke nogen due process. Ud med lortet ASAP. Ingen undersøgelser her, tak!

SEIA er vel en egen organisasjon som jobber for egne interesser. De bryr seg ikke om jobbene, de er interessert i å importere billige paneler fra Asia, de ser ingen fordeler med innenlands verdikjede uavhengig av Asia. Skittent spill.

WASHINGTON, D.C. — In response to an anonymous petition for circumvention tariffs on solar imports from Southeast Asia, the Solar Energy Industries Association (SEIA), the national trade group for the U.S. solar and storage industry, sent a letter to U.S. Department of Commerce Secretary Gina Raimondo to refute the credibility of this baseless case.

The letter notes the legal deficiencies of the case and refutes a series of false narratives set forth by the group of petitioners, including the flagrantly false claim that SEIA rejects the need for domestic manufacturing and other allegations about SEIA’s interests.

Following is a statement from SEIA president and CEO Abigail Ross Hopper on the petition and why Commerce must reject it:

“Let me be clear: SEIA is the voice of America’s solar industry and represents the interests of American solar workers and companies. SEIA is leading the fight against these tariffs to protect this country’s 10,000 solar companies and 231,000 solar workers from the monied interests behind this petition.

“Without the integrity to identify who they are and who they represent, a shadow group of anonymous petitioners are recklessly asking our government to misinterpret U.S. law, upend the lives of thousands of American families and undermine any hope we have to mitigate the devastating impacts of climate change.

“SEIA was right to assert that the tariffs have failed the U.S. industry. We forecasted that the Section 201 tariffs would cause significant loss of deployment, jobs, and investment, and we now know that at least 10 gigawatts of solar installations, 62,000 American solar jobs and $19 billion in investment has been lost as a result. Meanwhile, the petitioners in the Section 201 case expected the tariffs to lead to 45,000 new manufacturing jobs when we actually lost thousands of manufacturing jobs in the four years since.

“Now the anonymous petitioners have brought on the same counsel as the Section 201 case to offer the same false promise. SEIA can confidently project that if circumvention tariffs are imposed, the U.S. will miss out on another 46,000 solar jobs by 2023, including 15,000 lost manufacturing jobs. The tariffs are ineffective, and we need long-term federal investments to drive domestic production, such as Senator Ossoff’s bill to provide a production tax credit for U.S.-made solar equipment.

“The bottom line is that the climate can’t afford these tariffs. Commerce should reject these baseless petitions now because the climate, the economy and thousands of American jobs are on the line.”

Ingen info, men spekulasjon.

Denne saken har en mer snarlig effekt på Moses-gjenåpning enn Biden-pakkene etter min mening. Med pakkene må man vente på at fabrikkene bygges i USA, som tar ca 1 år. Dersom tariffen vedtas, kan det skje en gjenåpning i løpet av måneder....

Dersom det kommer en tariff, og størrelsen på tariffen ikke er helt neglisjerbart, vil fabrikkene i Thailand, Vietnam og Malaysia nærmeste umiddelbart begynne å kjøpe inne polysil eller wafere fra USA og Europa. Trina Solar feks, ville ikke la fabrikkene i de har investert i Vietnam stå brakk.. de ville bruke den men med komponenter kjøpt fra Europa eller USA. Installatører i USA vil i etterkant fortsatt få sine paneler fra Asia. Prisen ville være litt høyere enn den var på bunn i 2018, men LAVERE enn i dag (pga at usikkerheten i forsyningskjeden vil da være borte).
