Det er helt fantastisk hvordan dette utfolder seg.

Blir det på grensen til konspirasjonsteorier hvis jeg sier at jeg innbiller meg at denne typen "circumvention" har vært et velkjent fenomen i lang tid, men at man ikke har hatt noe politisk momentum til å få gjort noe med dette før nå?

Ikke så ulikt "me too" eller diesel-skandalen som brast for VW, så kommer det mye rart til overflaten når man først oppdager at det er mulig å bli hørt?

Det virker på meg som at en "bylle" nå har brast (kanskje det skjedde da det ble et faktum at dette temaet var ansett som "a matter of national security", eller evt. enda tidligere), og som kan dra med seg mange flere skjulte utfordringer, som gradvis har hatt hendene på strupen til amerikansk solar verdikjede i flere år, til overflaten.

Dette er nok en vedvarende interessekonflikt. SEIA beskytter sine nåværende medlemmer, fordi dem vil miste jobben inntil en verdikjede i USA kan stables på beina.

Slik jeg tolker det, men da syns jeg politikere i USA må fatte noen gode tiltak som gjør at USA sin verdikjede kan klare å etablere seg også! Vanskelig å konkurrere mot Kina på urettferdige vilkår.

… det er jo forsovet det de prøver med med BBB. Subsidiere sektoren så industrien brygges opp - men demokratene ble litt for ivrige i å putte masse politisk kontroversielle ekstra ting inn.

Nå jobber de med en redusert BBB - så det kommer. Ting tar tid, men det kommer.

The company announced a plan to build its first high-volume manufacturing facility.

Amprius Technologies announced the shipment of the first commercially available 450 Wh/kg, 1150 Wh/L lithium-ion battery cells. They will be used in a new generation of High-Altitude Pseudo Satellites (HAPS).

According to the company, those are the first commercially available battery cells with such a high energy density.

A crucial element to achieving the result is Amprius' silicon anode (Si-Nanowire platform).

An interesting thing is that the company was able to achieve 450 Wh/kg just a few months after announcing the 405 Wh/kg product on November 8, 2021. In December, we also learned about the 370 Wh/kg version, which can be recharged from 0 to 80% state-of-charge in just about 6 minutes.

Currently, Amprius Technologies produces the battery cells at a limited scale at its facility in Fremont, California. Later this quarter, the company intends to select a location for its first high-volume manufacturing facility in the US.

WASHINGTON, DC – Today, U.S. Senators Rob Portman (R-OH) and Sherrod Brown (D-OH) sent a letter to Commerce Secretary Gina Raimondo urging her to accept the anti-circumvention petition alleging that Chinese solar companies have moved manufacturing to countries like Malaysia, Thailand, and Vietnam to circumvent our Antidumping and Countervailing Duty (AD/CVD) orders against Chinese-made solar cells and modules.

“A strong commitment to American manufacturing must be paired with proper trade enforcement so that investments in American production, workers, and innovation are not undermined by unfair trade practices. That is why the Department of Commerce must fully and fairly examine these allegations of illegal and unfair circumvention of our trade remedy laws,” wrote the senators.

The senators’ Leveling the Playing Field 2.0, which they introduced last April, will strengthen U.S. trade remedy laws and ensure they remain effective tools to fight back against unfair trade practices and protect American workers. The senators’ legislation would establish the new concept of “successive investigations” to improve the effectiveness of the U.S. trade remedy system in responding to repeat offenders and serial cheaters, helping to level the playing field for American workers.

Dear Secretary Raimondo:

We write to encourage you to accept the recently filed petition from a minority-and-woman-owned business related to solar cells and modules imported in circumvention of the existing antidumping and countervailing duty (AD/CVD) orders on Chinese solar cells and modules. A strong commitment to American manufacturing must be paired with proper trade enforcement so that investments in American production, workers, and innovation are not undermined by unfair trade practices. That is why the Department of Commerce must fully and fairly examine these allegations of illegal and unfair circumvention of our trade remedy laws.

In trade remedy cases, the length—on average 14 months from first filing to relief—makes clear that justice delayed is justice denied. Yet, even timely justice can be thwarted by circumvention, which has been a consistent strategy of anticompetitive global actors seeking to escape the requirements imposed by U.S. law. Therefore, after the International Trade Commission (ITC) finds that there is evidence of unfair trade, the Department of Commerce must ensure that the decision by the ITC stands. When duties have been imposed on specific products from specific countries, unfairly traded imports should not then be able escape our AD/CVD orders by being routed through additional third countries. Congress provided anti-circumvention authority to Commerce in 1988 to ensure that injured domestic industries obtained the full relief of the trade remedy laws and not just half loaf.

In this instance, a U.S. manufacturer alleges that after imposition of AD/CVD orders against Chinese-made solar cells and modules, Chinese companies established new operations in Malaysia, Thailand, Vietnam, and Cambodia to escape the strictures of U.S. trade remedy law and maintain control over the global solar supply chain. As we understand it, these operations use raw materials, labor, capital investment, and research and development from China. Moving to a third country to assemble a product with inputs from the country subject to the original AD/CVD order is textbook circumvention. As you know, if legitimate circumvention allegations go unaddressed, entire domestic industries and thousands of American manufacturing jobs are at risk.

Strong enforcement of our trade laws to level the playing field on which American companies and workers can compete lays the foundation to rebuilding a robust solar industrial base in the United States. Thank you for your consideration of our request, and we thank you for your diligence in this circumvention inquiry.

Commerce’s move to extend the review period comes just four months after it rejected another request for investigations into alleged AD/CVD circumvention in Southeast Asia, citing the anonymity of the group behind the petition.

However, that petition – filed in August 2021 – slowed solar deployment in the US as some foreign PV equipment suppliers withheld shipments until business certainty was established, the companies said in their letter to Raimondo. “Many solar projects were delayed, including projects under construction, and many jobs were lost,” they said.

George Hershman, CEO of solar developer and O&M provider SOLV Energy, said Commerce’s decision to extend the review period for the petition “will come at a high cost for the solar industry”, adding: “Every day the threat of tariffs looms, tens of thousands of jobs and countless projects hang in the balance.”

In its filing, Auxin alleges that cell and module assemblers in Southeast Asia use affiliated Chinese input suppliers and a fully integrated Chinese supply chain to circumvent the AD/CVD orders. In a press release published when the petition was announced, Auxin CEO Mamun Rashid said the operations described in its filing represent “textbook circumvention”.

Research published today by SEIA and analyst firm Wood Mackenzie revealed that while solar deployment in the US reached a record high in 2021, utility-scale additions are set to fall this year because of supply chain uncertainty and volatile commodity prices. Their US Solar Market Insight report warned of the significant increase in module prices if additional tariffs are eventually introduced.

(Bloomberg) -- The head of a small California solar-panel maker asking Washington to investigate whether Asian competitors are evading U.S. tariffs says industry claims that a mere probe could freeze investments is fearmongering.

“If nothing has been done wrong, there’s nothing to be afraid of,” Auxin Solar Inc. Chief Executive Officer Mamun Rashid said in his first interview since the company petitioned the U.S. Commerce Department in February to initiate an investigation.

The Commerce Department is set to decide by March 25 whether to formally investigate equipment that’s assembled in Malaysia, Thailand, Vietnam and Cambodia using parts and components from China.

Our opponents contend that we’re putting the climate at risk because solar installations will decrease if solar panel costs increase. But with a level playing field, costs will not increase. Republicans and Democrats alike agree with us. And so does President Biden. In his State of the Union address, the president noted the higher international shipping costs, the costs of factory closures, and the costs of warehousing now being borne directly by American families.

These costs can all be avoided by shifting to domestic solar manufacturing. And Members of Congress agree. In fact, a bipartisan House group recently sent a letter to President Biden urging support for our trade case against Chinese solar products being sold at below-market value.

In 1954, Bell Labs in New Jersey created the first silicon solar cell. It was created here in the U.S. And then China stole that technology. Auxin Solar is dedicated to reshoring this important supply chain.

American companies play by the rules. When the playing field is fair, American companies win. It’s time to give U.S.-made solar a chance once again.

Even a Commerce Department decision to initiate the case would disable the $25 billion U.S. solar industry. Uncertainty over product costs and supply chain reliability caused by the investigation itself would halt progress and eliminate good jobs.

Solar equipment manufacturers have been eyeing opportunities to invest in America since last year when energy tax legislation was introduced in Congress. These climate and energy policies, first included in Biden’s Build Back Better plan, focus on deploying solar and building factories right here in the United States.

Companies such as Enphase, REC Americas, Maxeon, Hanwha Q CELLS and Meyer Burger are looking to create manufacturing capacity or expand existing facilities here in the U.S., and many others have a watchful eye on Congress. If this legislation passes, we will see immediate growth in solar inverter, racking and tracker manufacturing in states across America as well as new investments in domestic ingot and wafer and cell manufacturing capacity.

Ingot and wafer plants would help U.S. polysilicon manufacturers, which in turn will lead to business for U.S. silicon metal producers in places like West Virginia, Alabama and Mississippi.

The opportunity before us is nothing short of a solar supply chain revolution. When you think about the clean energy transition, you should also be thinking “build, baby, build.” That must be paired with sensible policy.

America has the means to become more energy and climate secure, and now we need leaders to recognize the urgency of this moment. Congress and the Biden administration must swiftly act and support policies to grow our nation’s clean energy self-reliance, or we’ll miss out on the historic chance to dictate our own clean energy manufacturing and deployment future. We cannot afford to wait.

On Monday, Auxin added fuel to the fire, warning Commerce that the petition had triggered a rush to import and stockpile solar panels and cells made in the four targeted Asian countries.

In the first five weeks of 2022, the U.S. imported as many solar cells as in one 38-week period in 2021, with “an enormous volume” originating from the four targeted countries, wrote Auxin’s lawyers, citing data from U.S. Customs and Border Protection.

Auxin accused solar companies based in Asia of trying to get ahead of possible new tariffs in the U.S. and said Commerce should provide “retroactive relief” if and when it decides to apply tariffs.

“This flood of imports is a naked attempt by these exporters to double-down on their circumventing behavior and to stockpile solar cells and modules,” Auxin wrote.

“Commerce should not tolerate such blatant attempts to evade duty liability,” its lawyers added.

Yesterday, SEIA dismissed Auxin’s latest filing, saying the company was “complaining” about a flood of solar-cell imports despite the fact that virtually no cells are manufactured in the U.S.

If Commerce were to grant Auxin’s request and start a probe, solar imports from the four Asian countries would “slow to a trickle” because of “massive uncertainty about costs going forward,” predicted John Smirnow, the Solar Energy Industries Association’s vice president of market strategy, in a statement.

“Since we get 80% of our imports from these countries, the initiation of the case alone will stifle deployment and lead directly to an increase in U.S. carbon emissions,” Smirnow added, while urging Commerce to reject the petition.

“This is a blatant attempt by Auxin to unfairly gain a competitive advantage, to the great detriment of other domestic module manufacturers and the American solar industry at large,” he said.

The petition is the most immediate policy focus for solar trade representatives, as a wider package of incentives remains hung up in Congress. Commerce is expected to decide whether to begin an investigation by the end of tomorrow
