Today’s clean energy technologies are a critical part of the arsenal we must harness to lower energy costs for families, reduce risks to our power grid, and tackle the urgent crisis of a changing climate. From day one, President Biden has mobilized investment in these critical technologies. Thanks to his clean energy and climate agenda, last year marked the largest deployment of solar, wind, and batteries in United States history, and our nation is now a magnet for investment in clean energy manufacturing.

Since President Biden took office, the private sector has committed over $100 billion in new private capital to make electric vehicles and batteries in the United States. We have made historic investments in clean hydrogen, nuclear, and other cutting-edge technologies. And companies are investing billions more to grow a new domestic offshore wind industry.

We are also now on track to triple domestic solar manufacturing capacity by 2024. The expansions to domestic solar manufacturing capacity announced since President Biden took office will grow the current base capacity of 7.5 gigawatts by an additional 15 gigawatts. This would total 22.5 gigawatts by the end of his first term – enough to enable more than 3.3 million homes to switch to clean solar energy each year.

While President Biden continues pushing Congress to pass clean energy investments and tax cuts, he is taking bold action to rapidly build on this progress and create a bridge to this American-made clean energy future. Today, President Biden is taking action to:

- Authorize use of the Defense Production Act (DPA) to accelerate domestic production of clean energy technologies, including solar panel parts;

- Put the full power of federal procurement to work spurring additional domestic solar manufacturing capacity by directing the development of master supply agreements, including “super preference” status; and

- Create a 24-month bridge as domestic manufacturing rapidly scales up to ensure the reliable supply of components that U.S. solar deployers need to construct clean energy projects and an electric grid for the 21st century, while reinforcing the integrity of our trade laws and processes.


Together, these actions will spur domestic manufacturing, construction projects, and good-paying jobs – all while cutting energy costs for families, strengthening our grid, and tackling climate change and environmental injustice. With a stronger clean energy arsenal, the United States can be an even stronger partner to our allies, especially in the face of Putin’s war in Ukraine.

The stakes could not be higher. That is why President Biden also continues to urge Congress to quickly pass tax cuts and additional investments that advance U.S. clean energy manufacturing and deployment. Failing to take these actions would deny consumers access to cost-cutting clean energy options, add risks to our power grid, and stall domestic clean energy construction projects that are critical to tackling the climate crisis. According to reports, alongside the moratorium on new tariffs, President Biden will invoke the Defense Production Act as a means to accelerate American manufacturing across the solar supply chain and alleviate overall dependency on imported PV hardware and materials. Reports indicate that the goal of invoking the act is to raise domestic solar manufacturing capacity to 22.5 GW by 2024.

Enacted in 1950, the Defense Production Act allows the President to to direct private companies to prioritize orders from the federal government and allocate materials, services, and facilities for the purpose of national defense. The order has been invoked twice since the beginning of 2020, once by then-President Donald Trump and again by Biden, in response to the Covid-19 pandemic.

Invoking the Act will not end the DOC investigation, which is expected to continue, meaning that tariffs could still be imposed after the moratorium, depending on DOC’s ruling. However, according Reuter’s unnamed source, the impending action would eliminate the possible imposition of retroactive tariff collection, which could have gone as far back as the date of Auxin Solar’s initial petition filing.

US President Joseph Biden issued a directive to the secretary of defense on March 31, invoking the Defense Production Act (DPA) to spur the domestic production of critical minerals needed to produce large-capacity batteries for the automotive, emobility, and stationary electricity storage sectors.

The president’s executive action is in direct response to the Biden-Harris administration’s longstanding concern that the existing supply chain and domestic capabilities to produce large-capacity batteries are insufficient to meet current and projected production and consumer domestic demand for the growing electric vehicle (EV) market. The administration’s action also aims to relieve the United States’ reliance on foreign oil while aiding a swift transition to a clean energy future.

The DPA provides the president authority to shape national defense preparedness programs and take appropriate steps to maintain and enhance the domestic industrial base. While the DPA was originally enacted in 1950, it is now used to enhance and support domestic preparedness for response and recovery from natural hazards, terrorist attacks, and other national emergencies.

Under the DPA, the president may require companies to prioritize and accept contracts for materials and services as necessary to promote the national defense, incentivize the domestic industrial base to expand production and supply of critical materials and goods, and establish voluntary agreements with private industry. The president may delegate these authorities to department and agency heads.

Therefore, by the authority vested in me as President by the Constitution and the laws of the United States of America, including section 303 of the Defense Production Act of 1950, as amended (the “Act”) (50 U.S.C. 4533), I hereby determine, pursuant to section 303(a)(5) of the Act, that:

(1) solar photovoltaic modules and module components, including ingots, wafers, solar glass, and cells, are industrial resources, materials, or critical technology items essential to the national defense;

(2) without Presidential action under section 303 of the Act, United States industry cannot reasonably be expected to provide the capability for the needed industrial resource, material, or critical technology item in a timely manner; and

(3) purchases, purchase commitments, or other action pursuant to section 303 of the Act are the most cost effective, expedient, and practical alternative method for meeting the need.


Pursuant to section 303(a)(7)(B) of the Act, I find that action to expand the domestic production capability for solar photovoltaic modules and module components is necessary to avert an industrial resource or critical technology item shortfall that would severely impair national defense capability. Therefore, I waive the requirements of section 303(a)(1)–(a)(6) of the Act for the purpose of expanding the domestic production capability for solar photovoltaic modules and module components.

You are authorized and directed to publish this determination in the Federal Register.

The Act also played a vital role in the establishment of the domestic aluminum and titanium industries in the 1950s. Using the Act, DOD provided capital and interest-free loans, and directed mining and manufacturing resources as well as skilled laborers to these two processing industries.

Kanskje garantier om kommende presidentordrer for solbransjen var det som gav Hanwha trygghet nok til å kjøpe seg inn i Rec og garantere ML oppstart, tross at gjennomslag SEMA synes alt annet enn sikkert. Jeg ser intet negativt i dette heller - 2 års sikkerhed for importører, mens RECSI får lov til at trappe produktionen op i ML. Hvis timelinen passer, vil fuld produktion jo være et tidspunkt i slut 2024… akkurat som denne sikkerhed udløber.

Så vi vil forhåbenligt se udfasning af import, i takt med Moses Lake fabrikken trapper produktionen op.

Hvis altså AD/CVD undersøgelsen resulterer i tariffer. Vi må se i August.
