GiG Subsidiary Loses Battle Against
Dutch Ailiate Punishment

Ailiate marketer Innovation Labs Limited, a subsidiary of Gaming Innovation Group (GIG), has
failed in its bid to avoid sanction from the Dutch regulator, it was announced on Wednesday.
The Netherlands Gambling Authority (KSA) has published the details of a long-running
enforcement case against Innovation Labs and its parent company GIG, nally rejecting the
former’s appeals almost 15 months after the original complaint.
Innovation Labs was reprimanded for its ailiate website www.topcasinobonus.nu, which uses
the non-country specic URL ".nu". However, the web address www.topcasinobonus.nl, which
uses the Netherlands’ national top level domain, did, and still does, redirect to the dot.nu site.
According to documents published by the KSA on Wednesday, the website was being used to
advertise "illegal" online gambling providers in the Netherlands.
The site was written in Dutch, one of the regulator’s key tests of whether a company can be said
to be "targeting" the Dutch market, which in turn was a trigger for enforcement action.
In November 2017, the KSA informed GIG and Innovation Labs that it had two weeks to cease
prohibited advertising on topcasinobonus.nu and any other Dutch-facing sites or face a ne of
€1,500 per day, up to a maximum of €21,000.
However, a series of complaints from GIG and Innovation Labs lawyers prevented the
publication of the enforcement action until Wednesday, when the regulator formally rejected
those appeals.
It did, however, drop all complaints against GIG, owing to a confusion over which corporate
entity had ultimate responsibility for the oending website.
As of time of publication, topcasinobonus.nu is still operating and its content is still written in
Dutch, although its ailiate links have been replaced with generic descriptions of bonuses and a
series of messages clarifying that Dutch legislation prevents it from advertising online casinos.
In a statement sent to GamblingCompliance, a GIG spokesperson said that since December
2017, "Innovation Labs has taken all steps necessary to remove all advertising content from its
website and to comply with the order issued by the KSA" and that the Dutch regulator told the
company in March 2018 its website was now compliant.
"GIG welcomes regulation and we are pleased with the developments made in the Netherlands

licences in the regulated Dutch market," said the spokesperson.
The KSA’s decision to go directly after an ailiate, rather than the operators it partners with, is
somewhat unusual on the European scene.
"Back in 2017 the Gambling Authority issued a spate of cease and desist notices to ailiates,
triggered by advertising for remote gambling operators which had been sanctioned for their
oer in the Netherlands," explained Alan Littler, a gaming lawyer with Dutch rm Kal Katz &
Franssen.
"Given the lack of traction which the Gambling Authority often experiences when seeking to
enforce against remote operators it turned its attention to hindering their ability to reach the
Dutch market. Serving these notices against ailiates is one such approach," he said.
In a brief statement to GamblingCompliance, the KSA made clear that it has not nished
exploring the line of attack. "We are going to continue to punish ailiates marketing illegal
operators," said a spokesperson.
"Once the licensing regime is up and running ailiate advertising will have to comply with local
requirements, and to the extent that ailiates advertise locally unlicensed operators then they
can probably expect the gambling authority to be far more active than at present," added
Littler.
"The grey zone in the middle will evaporate and it will become a case of being compliant,
leaving the market or being on the receiving end of the authority’s enforcement measures.”
Future ailiate oenders may also face stier nes, with the KSA recently promising to
undertake a wholesale reform of its enforcement policies.

Godt jeg fortsatt har en del flasker i vinkjelleren, så jeg kan holde noen uker til før jeg må ty til papp? Tenker det begynner å røre på seg i løpet av neste uke. Nå må det jo uansett komme noe rundt flyttingen til Stockholm, hvis de skal rekke det i løpet av mars. Jeg vet ikke hvilken informasjonsfrist det er på sånt, men det kan da ikke være lenge igjen nå. Kanskje de sparer noen gode nyhetene til etter flytting. (selv om det strengt tatt ikke er lov) Uansett god helg, i dag blir det litt god rødvin i glasset, så jeg fortsetter feiringen på forskudd. God helg?

Blir veldig, veldig spennende å følge gig de neste månedene. I 2018 snakket man om HR, wow og CMD...uten at det ga særlig effekt. Nå er det Stockholm som gjelder så la oss håpe det blir litt trøkk igjen.

n November 2017, Innovation Labs Ltd. (trading as GiG Media, part of Gaming Innovation Group Inc.) received two orders subject to a penalty from the KSA for an alleged violation of the promotion prohibition of gambling in the Netherlands.

Since December 2017, Innovation Labs Ltd. has taken all steps necessary to remove all advertising and affiliate links on its website and to comply with the order of the KSA. In March 2018, the KSA confirmed that the website, as amended, does not violate the Dutch Gaming and Betting Act and also confirmed compliant status of the site. The same applies to all other affiliate sites owned and operated by GiG Media which fully comply with the requirements of the KSA.

The Netherlands adopted the remote gambling bill in February this year, a development which GiG welcomes. GiG intends to be present in the regulated Dutch market through its operating entities and in the interim continues to comply with the requirements known as the prioritisation criteria. The orders subject to a penalty accepted by Innovation Labs Ltd. do not qualify as a fine and does not impact GiG’s eligibility to apply for a future Dutch licence.

GiG announced in its Q4 2017 report, its decision to remove all advertisement from Dutch facing affiliate websites. This decision was also commented on in its 2018 quarterly reports.

Når man går ut på en slik måte at det oppfattes som avtalen blir underskrevet hvilken dag som helst, så bør det ikke gå over en måned uten at man hører noe mer.

Regner med at det ikke er GIG som holder igjen her. Hvis jeg husker riktig så nevnte RR på Q4 presentasjonen at de alt hadde et team som jobbet med den nye klinenten. Godt mulig at det er et ønske fra klienten sin side å lansere så fort som mulig etter at de har signert, og at de derfor venter til produktet er klart.

Jeg regner med GIG ikke slipper noe særlig nyheter før dem er over på Nasdaq/Stockholm nå, og det burde så absolutt komme når GIG skal over, og det er jo meddelt at det skal være listing både på Oslo og Stockholmsbørsen en periode, før dem tar GIG av Oslo og blir kun i Stockholm...Den som venter på noe spennende venter ikke forgjeves, selv om siste året har føltes som en evighet :-)

The draft of the Third German State Treaty on Gambling has been published, with the prime ministers of Germany’s sixteen federal states due to vote on the proposal next week.

As first reported by Gaming Intelligence, the draft treaty extends the current sports betting “experiment”, under which the state betting monopoly was suspended and the market opened to private competition, to June 30th, 2021.

It also removes the cap on available sports betting licenses, with the state of Hesse retaining its role as the licensing authority. All other criteria remain the same, bypassing the need for European Commission notification and allowing the authorities in Hesse to begin issuing licensed as soon as the Treaty is ratified.

The Third State Treaty on Gambling would come into force on January 1st, 2020, subject to ratification by all German states before the end of this year.

The state prime ministers will consider the draft at their next meeting on March 21st.
