Update on Patent Litigation between Magseis Fairfield and Seabed



Magseis Fairfield has alleged that Seabed Geosolutions' MANTA system infringes
four U. S. patents (numbered RE45,268 ; 9,829,589 ; 8,879,362 ; and 8,228,761) in a
lawsuit pending in the U.S. District Court for the Southern District of Texas.

In 2018 Seabed filed petitions with the Patent Trial and Appeal Board ("PTAB")
of U.S. Patent and Trademark Office ("USPTO") for inter partes review ("IPR") of
the four asserted patents.

The PTAB denied institution of IPR against U.S. Patent No. 9,829,589 and
instituted IPR for the other three patents. The U.S. District Court
subsequently stayed the patent infringement suit against Seabed pending
resolution of the IPR proceedings.

In November of 2019 the PTAB issued final written decisions on two IPRs,
upholding the validity of claim 8 of U.S. Patent No. 8,226,761. Magseis
Fairfield is currently considering an appeal of the decisions to invalidate
claims of U.S. Patent No. 8,879,362 and U.S. Patent No. 8,226,761.

The IPR against U.S. Patent No. RE45,268 remains pending with a decision
expected shortly.

Magseis Fairfield looks forward to continuing its patent lawsuit against Seabed
with all valid patent claims, including those of U.S. Patent No. 9,829,589, and
will continue to seek all available remedies for Seabed's past and ongoing
infringement, including lost profits, a reasonable royalty, and an injunction
against the MANTA system.

Magseis Fairfield is pleased to announce that on November 26, the Patent Trial and Appeal Board (“PTAB”) of the U.S. Patent & Trademark Office issued a Final Written Decision rejecting Seabed Geosolutions’ attack on the validity of U.S. Patent RE45,268 (the ’268 Patent).

Magseis Fairfield has accused Seabed’s MANTA system of infringing the ’268 Patent in a lawsuit pending in the U.S. District Court for the Southern District of Texas. Seabed sought to attack and invalidate the ’268 Patent through an Inter Partes Review before the PTAB that resulted in the Final Written Decision rejecting all of Seabed’s invalidity arguments.

Magseis Fairfield looks forward to continuing its patent infringement lawsuit against Seabed and recovering all available remedies for Seabed’s past and ongoing infringement of the ’268 Patent, including lost profits, a reasonable royalty, and an injunction against the MANTA system.

Blir spennende å se hva dette vil bety for aksjekursen fremover.
Å vinne denne saken må være utrolig viktig og ikke minst for salget av EGEN teknologi i markedet. Hva vil dette bety av erstatning kan man bare gjette på, men det blir nok et betydelig beløp og burde alene være kursdrivende en god del oppover. I kjølevannet av dette kommer nok kontraktsmeldinger også.
Man kan bare lure på hva tapet betyr for Seabed? Hva med kontraktene de allerede har inngått med mseis -teknologi?

DN har ikke helt fått med seg at anken er en mindre viktig nyhet sammenlignet med at node patentet består selv etter å ha blitt behandlet for ugyldighet. Anken kan gjøre at flere pantenter blir gyldige og blokkerer konkurrentene ytterligere.

Hadde selv problem med å få med meg hele budskapet i meldingen. Hvis man ikke er forretningsadvokat, så må man ha fulgt saken for å sette bitene på rett plass sånn med en gang. 🙂
