Host Mark Levin asked Hemingway about the idea that Rice raced back to the White House just after noon on Inauguration Day to send a "self-serving" email regarding a Jan. 5 Oval Office meeting where the investigation of her designated successor, Michael Flynn, apparently was discussed.
According to Levin, Rice wrote in the email that Obama "stress[ed] his continued commitment to ensuring that every aspect of this issue is handled by the intelligence and law enforcement communities by the book."
Hemingway said the word "continued" suggested that Obama knew about the Trump campaign investigation prior to the Jan. 5 meeting.
"What I also like is when she says they openly talked with the people who would be continuing on into the Trump administration about how to keep information from the Trump administration, and that is completely inappropriate," she said.
"This was about making sure that they could sideline people who would expose what they had been doing throughout the campaign, throughout the transition," Hemingway said, adding that Flynn likely became "target number one" because he had the experience and knowledge of the intelligence field that would have enabled him to call foul on the Obama administration's actions.
"He would have known that it was fishy and problematic. And so he was a high-priority target in the days that followed," she said.
"Almost immediately after this January 5 meeting, you start seeing a coordinated leak campaign to set a false narrative about some crazy story about Russia collusion," Hemingway added, blaming the "compliant and complicit" mainstream media for "regurgitat[ing]" White House leaks that painted a picture of the Russia collusion narrative.

No, President Donald Trump is not ranting and raving about Obamagate to keep himself center stage or to distract attention from COVID-19, as liberal media are suggesting. They still don't get Trump.
Two recent columns contend that Trump has ulterior motives in harping on Obamagate – the notion that the Obama administration tried to destroy Trump with the myth that he colluded with Russia to steal the 2016 election.
Wrong. How about we draw the most obvious inferences from Trump's statements instead of the liberal establishment's theories, which are far more outlandish than the Obamagate conspiracy they're ridiculing.
Everyone knows that Trump has long been outraged by the Russia hoax, and with good reason. Even after he has been thoroughly vindicated of this frame job, the perpetrators have escaped accountability, and the left still pretends Trump is the guilty party.
Trump was effectively exonerated when the vaunted, high-powered and obscenely funded team of Special Counsel Robert Mueller couldn't find a shred of evidence to tie Trump to Russian election meddling. Now, with the revelation that Obama administration officials and the FBI collaborated to incriminate former National Security Adviser Michael Flynn, the retired Army lieutenant general, we have a smoking .357 Magnum in the hands of scores of those officials.
It is the liberal media – not Trump – who are trying to divert the public's attention from a story – the one showcasing the Democrats' complicity.
If we had never heard of COVID-19, Trump would be railing against this corruption even more vigorously than he is now, because most of his day is consumed by virus-related health and economic issues. But don't bother telling that to Trump-obsessed journos.
CNN's Oliver Darcy writes that although the virus has killed more than 82,000 and left millions unemployed, Trump and his conservative media allies are "constructing a separate alternate reality to keep their fans distracted from the news and outraged at the long-standing villains in the right-wing media universe."
Though this might stun Darcy, we hayseed Trump deplorables are capable of walking and chewing tobacco simultaneously. Notwithstanding our diminished capacity, we stay abreast of virus and economic updates, which constitute 99.9 percent of the news, even with coverage of the Obamagate story the liberal media are trying to suppress.
Actually, Trump wants us to focus on the virus and on out-of-work Americans because he is determined to prudently reopen the economy precisely to help the same people these journos claim he is ignoring. If Trump were trying to shift our attention from the economy or the virus, why would he publicly disagree with Dr. Anthony Fauci on the reopening of schools in the fall? Moreover, it is inconceivable that he could avoid virus-related issues during the campaign even if he tried. The media's diversion claim is patently absurd.
Politico's Jack Shafer is promoting the bizarre theory that Trump is pushing Obamagate and other "outrageous claims" because he wants the spotlight on himself, even if only for critical coverage:
"Making him the subject of our conversations is almost as good to Trump as making him the video camera's focal point. ... Obviously, he'd like it better if the commentariat praised him, but if they're going to criticize him, he's content to annotate the insults and censures and repurpose them as offensive weapons. ... Baseless charges like these (Obamagate, China, Joe Scarborough, QAnon) are the perfect refuge of a rhetorical arsonist like Trump, who scorches the earth with controversy and confusion so nobody knows where to find the truth."
Sorry, Mr. Schafer, but Trump truly believes he was set up with the Russia hoax, and the evidence supports him. That's why he's ranting about it even while COVID-19 is still with us.
No matter how much you mock it, no matter how much you want the country to focus solely on the virus, life has to go on, and other issues, especially Obamagate, still matter.
There must be a reckoning for the political party that abused governmental power to engineer a coup against the other party. In a saner world, Democrats would agree with this, as it was the premise upon which the bogus Russia-Trump investigation was based.
Progressives pounded the table for three years over Trump's alleged theft of the election, and they now expect us to shuffle docilely into the night when we have his opponents dead to rights doing the very thing they accused him of doing?
So, no, gentlemen, you are hopelessly off base. Trump intends to keep the coronavirus-related issues on the front burner. They must be if he is to lead America back to health and wealth. Unlike the left, he is not ignoring the economic devastation caused by this virus. Unlike the left, he is taking action instead of engaging in "rhetorical arson," if I may humbly borrow Schafer's incendiary term.
The left can smear Trump from their basements for not waving his wand and immediately accelerating our COVID-19 testing capacity to a billion per month and for the economic devastation caused by shutting down the economy. But they show unprecedented audacity blaming him for a death count that would have been worse and for an economic shutdown that would go on indefinitely if they were in charge.
Unhappily for the media, President Trump is alert, engaged and proactively addressing a comprehensive range of issues affecting Americans. He is fully capable of calling attention to this Democratic corruption of shocking magnitude without impeding his efforts to make America well and prosperous again.

By then, Biden was already the putative Democratic presidential nominee. Obviously, if serious consideration were being given to an indictment of Biden, Barr would not have made the point about the guideline.
To be sure, the media reporting will portray Barr’s latest comments as indicative of a rift between the AG and President Trump, whose latest “Obamagate” rhetoric frames Obama-era investigative abuses as “crime.”
Barr’s remarks will also be applauded as an “exoneration” of Obama officials — consistent with the media approach that portrays Democrats as innocent victims of right-wing smears if they manage to evade indictment, while a “guilty until proved innocent beyond any doubt” standard is applied to Republicans.

Former FBI Director James Comey suggested to then-President Barack Obama in a January 2017 meeting that the National Security Council might not want to pass "sensitive information related to Russia" to then-incoming national security adviser Michael Flynn, according to a newly declassified email that Flynn's predecessor sent herself on Inauguration Day.
The note from Susan Rice was declassified by Acting Director of National Intelligence Richard Grenell and transmitted to the Justice Department.
The Jan. 20, 2017 email Rice sent to herself documented a Jan. 5, 2017 Oval Office meeting with Obama and others, where he provided guidance on how law enforcement should investigate Russian interference in the 2016 presidential race. Parts of it were previously released, but the section on Comey's response had been classified as "TOP SECRET" until now.
The section says that Comey affirmed to Obama he was proceeding "by the book."
Rice continued: "From a national security perspective, Comey said he does have some concerns that incoming NSA Flynn is speaking frequently with Russian Ambassador Kislyak. Comey said that could be an issue as it relates to sharing sensitive information. President Obama asked if Comey was saying that the NSC should not pass sensitive information related to Russia to Flynn."

He reiterated that our law enforcement team needs to proceed as it normally would by the book.”
The email also appeared to reflect Obama’s guidance on sharing sensitive information with both the Russians and the incoming Trump administration.
Rice wrote that Obama said, “he wants to be sure that, as we engage with the incoming team, we are mindful to ascertain if there is any reason that we cannot share information fully as it relates to Russia.”

The email Rice sent to herself on Jan. 20, 2017, documented a Jan. 5 Oval Office meeting with former President Barack Obama and others, during which he provided guidance on how law enforcement should address Russian interference in the 2016 presidential race. That section says Comey suggested to Obama that the National Security Council [NSC] might not want to pass “sensitive information related to Russia” to incoming National Security Adviser Flynn.
The email pointed to what were apparently widespread concerns about Flynn's Russa contacts. Multiple sources confirmed to Fox News that what initially put Flynn on the radar was the number of interactions he had with senior Russian government officials in 2016, as laid out in various intelligence reports viewed by Obama White House

The statements also came after a list of names was made public last week revealing that top Obama administration officials purportedly requested to "unmask" the identity of Flynn during the presidential transition period.
Hemingway noted Obama “is becoming more public,” during a conversation with host Brian Kilmeade regarding the traditional reluctance among presidents to criticize a successor.
Kilmeade noted on Wednesday that “things have certainly changed” and asked Hemingway, “what happened to that presidents club?”
“This is a norm that we’ve had for a really long time, this idea that presidents should not undermine their successors or attack each other,” Hemingway said in response. “This hasn’t really been kept to as perfectly as some people think. I mean there are plenty of examples of people privately or publicly disparaging their successors.”

Comey suggested to Obama that the National Security Council (NSC) might not want to pass "sensitive information related to Russia" to Flynn, according to a newly declassified email that Flynn's predecessor sent herself on Inauguration Day.
The section showed that Comey affirmed to Obama he was proceeding "by the book," and went on to discuss concerns about Flynn's known conversations with Russia's ambassador at the time -- conversations that would play a role later in the criminal case against Flynn.
Rice continued in her email: "From a national security perspective, Comey said he does have some concerns that incoming NSA Flynn is speaking frequently with Russian Ambassador [Sergey] Kislyak. Comey said that could be an issue as it relates to sharing sensitive information. President Obama asked if Comey was saying that the NSC should not pass sensitive information related to Russia to Flynn."
Rice then wrote: "Comey replied, 'potentially.' He added that he has no indication thus far that Flynn has passed classified information to Kislyak, but he noted that 'the level of communication is unusual.'"
McEnany said Wednesday that even after the Jan. 5 meeting, Rice went to a passing-of-the-baton event with Flynn “where she praised him, wished him success and talked about the great transition into the White House.”
In a statement Tuesday evening about the email's release, a representative for Rice stressed that “no discussion of law enforcement matters or investigations took place, despite accusations to the contrary.” The spokeswoman also insisted the Obama administration did not change the way it briefed Flynn, saying Rice briefed Flynn for more than 12 hours on four separate occasions during the transition.
“Ambassador Rice did not alter the way she briefed Michael Flynn on Russia as a result of Director Comey’s response,” representative Erin Pelton said.
Last week, a list of top Obama officials who had requested the "unmasking" of Flynn was released. The list included Comey, former Vice President Joe Biden, former CIA Director John Brennan, former Director of National Intelligence (DNI) James Clapper, former U.N. Ambassador Samantha Power and former White House Chief of Staff Denis McDonough.

On Thursday the U.S. Court of Appeals for the D.C. Circuit, on its own motion, ordered Judge Sullivan to respond within 10 days to the petition for a writ of mandamus filed by former National Security Adviser Michael Flynn.
Earlier this week, Flynn’s counsel, Sidney Powell, filed the petition for that extraordinary writ, asking the appellate court to instruct Sullivan to grant the Justice Department’s motion to dismiss the case against Flynn.
That was after Judge Sullivan not only declined to grant the prosecution’s motion, but (a) invited non-parties to intervene in the case by filing amicus briefs (transparently, to make arguments that he somehow has authority to deny DOJ’s motion); and (b) appointed one amicus, former federal judge John Gleeson, as a quasi-prosecutor to make arguments that prosecutors are declining to make in favor of entering a judgment of conviction and sentencing Flynn.
As I noted Wednesday, Sullivan’s encouragement of amicus briefs, which are not authorized in criminal cases, flies in the face of Sullivan’s own very firm orders previously declining to permit amicus briefs in Flynn’s case – some two dozen times by Powell’s count.
The appointment of Gleeson is equally astonishing and offensive to the principle of courts as impartial arbiters.

Judge in Flynn case hires lawyer as appeals court reviews his decision not to dismiss: report

U.S. District Court Judge Emmett G. Sullivan has taken the unusual step of hiring an attorney to represent him as an appeals court reviews his decision not to immediately grant the Justice Department's (DOJ's) request to dismiss its case against former National Security Adviser Michael Flynn.
Sullivan hired attorney Beth Wilkinson who, according to The Washington Post, is expected to notify the D.C. Court of Appeals within the next week of her decision to represent him. Wilkinson reportedly is a go-to for high-profile officials in difficult situations. For example, she previously represented then-Supreme Court nominee Brett Kavanaugh as he fought sexual misconduct allegations in 2018.
The added representation compounded what has become an abnormal case, which is rooted in Flynn misleading the FBI about his contacts with Russia after the 2016 presidential election. Although Flynn pleaded guilty, he's currently seeking to withdraw that plea as the Justice Department argues that the FBI had an insufficient basis to interview him in the first place.
Rather than granting the DOJ's dismissal, Sullivan appointed a retired judge to argue against the department’s position and to consider whether Flynn should be held in criminal contempt for perjury.
Flynn's attorneys responded with an emergency petition Tuesday arguing that Sullivan had “egregiously” overstepped his authority. They argued that the judge “has no authority to adopt the role of prosecutor or change the issues in the case.”
“This is an umpire who has decided to steal public attention from the players and focus it on himself,” the lawyers wrote. “He wants to pitch, bat, run bases, and play shortstop. In truth, he is way out in left field.” Flynn's lawyers are seeking to essentially bypass Sullivan in getting the case dismissed.
Sullivan has scheduled arguments on the dismissal motion for July 16. In the meantime, the FBI has opened an internal review into how the bureau handled the investigation into Flynn -- something that caught renewed scrutiny after FBI notes showed the agency discussing whether it intended to "get him to lie."

CNN peddled a false narrative in their Russia investigation coverage and it is "very obvious" they were played by Obama-era officials following the release of new Russia probe transcripts, Katie Pavlich stated Wednesday
In an interview on the "Brian Kilmeade Show," Pavlich said she believes the liberal network is trying to cover for years of "false" coverage by attacking right-wing media coverage of the case against former Trump National Security Adviser Gen. Michael Flynn and the events surrounding his investigation and eventual guilty plea.
"They used people like John Brennan and people from the FBI who were fired like Andrew McCabe -- who was then under investigation for lying to investigators. They used what they were saying as fact," she remarked.
"Do you remember all of the anonymous sourcing that we heard about? And every single bombshell story [that was] completely anonymously sourced?" asked Pavich. "Well, it wasn't sourced based on documents. It was based on political operatives from the Obama administration who continue to carry over this narrative."
Pavlich said Democrats thought they would never get caught because they underestimated President Trump's appointees, like Acting Director of National Intelligence Ric Grenell and thought House Intelligence Committee Chairman Adam Schiff, D-Calif., would keep information "behind closed doors."
As Fox News previously reported, Grenell made the decision to declassify information about Obama administration officials who were involved in the “unmasking” of Flynn.
"They never thought it would come to fruition and they look like fools..." Pavlich asserted. "Instead of taking a hard look at why they reported things incorrectly for years, they're just trying to change the narrative."
Responding to a clip of CNN host and media critic Brian Stelter, Pavlich took issue with the argument that the Flynn case does not deserve coverage because of the coronavirus pandemic.
"This is not a scandal for President Trump. You know, it's not his fault that the virus came from China. It's a Chinese virus. This is something that has happened to the country. This is not something that he did and then covered up. It's something that he's managing to the best of his ability.
"But, this is not a scandal for the Trump administration, as he claims," Pavlich told host Brian Kilmeade.
A video montage highlighting Stelter's change of heart regarding whether or not the Russia probe is newsworthy went viral on Tuesday, garnering more than 1.4 million views since it was published.

After former Deputy Attorney General Rod Rosenstein denied having knowledge of any altered documents or that the Steele dossier had been disavowed beforehand, McCabe responded by saying that Rosenstein’s claim that he was misled by him or anyone else at the FBI “are completely false.” Graham, R-S.C., told that he wants to press McCabe on his knowledge regarding the FBI’s interview with Steele’s sub-source, who denied the information in the dossier.
“Here’s what I would say to Mr. McCabe,” Graham said. “In the warrant application by the FBI and Department of Justice to the FISA court, you said that the Russian sub-source was truthful and cooperative. Inspector General Horowitz found a memo about the interview with the Russian sub-source saying the Russian sub-source disavowed all the information in the dossier, that it wasn’t reliable, that it was bar talk, it was hearsay, it shouldn’t be used to get a warrant.”
Graham said he is determined to make sure high-ranking officials who knew what was going on are held accountable.

Barr says FBI was ‘spring-loaded’ to investigate Trump campaign, ignored ‘exculpatory evidence’
In an exclusive interview Attorney General Bill Barr faulted the FBI for taking a “very aggressive” approach to investigating suspected Trump campaign ties to Russia and continuing to push forward even when, he says, their evidence was “falling apart.”
Barr alleged the bureau was eager to investigate President Trump's team both before the election and after he won in November 2016..
“I think before the election, I think we were concerned about the motive force behind the very aggressive investigation that was launched into the Trump campaign without — you know, with a very thin, slender reed as a basis for it,” Barr said in the two-part interview. The second part will air Tuesday at 6 p.m. EDT on Fox News’ “Special Report with Bret Baier.”
“It seemed that the bureau was sort of spring-loaded at the end of July to drive in there and investigate a campaign,” Barr added.
Barr went on to say that “there really wasn't much there to do that on, and that became more and more evident as they went by, but they seemed to have ignored all the exculpatory evidence that was building up and continued pell-mell to push it forward.”
The attorney general said that effort remained intense following Trump’s election, even as – he said – it became "painfully obvious" there was little basis.
“The other area of concern is that after the election, even though they were closing down, some of it as we've seen in the [Michael] Flynn case and say there's nothing here, for some reason they went right back at it, even at a time where the evidentiary support or claimed support, like the dossier, was falling apart,” Barr said, referencing the dossier compiled by ex-British spy Christopher Steele as part of Democratic opposition research.
“And it's — it's very hard to understand why they continued to push and even make public in testimony that they had an investigation going, when it was becoming painfully obvious, or should have been obvious to anyone, that there was nothing there,” he continued.
The question of when senior FBI officials knew about the weaknesses of the dossier has been a focus of Senate Judiciary Committee Chairman Lindsey Graham, who has been investigating the Russia probe’s origins. Graham pointed to how Steele’s sub-source had said during an FBI interview that the dossier was not accurate, even though it ended up being used to support a warrant application to conduct surveillance of Trump campaign adviser Carter Page.

Former acting Director of National Intelligence Richard Grenell told Monday that his time in the Trump administration has shown him that the great political struggle is no longer between Republicans and Democrats, but between the District of Columbia and the rest of the U.S.
In his first TV interview since leaving the administration, Grenell explained a tweet he posted Saturday in response to criticism of Trump from former Defense Secretary James Mattis.
"The fact of the matter is," Grenell said, "we have a real problem in Washington, D.C., because it’s a system that it no longer is Republicans and Democrats pushing against each other to create good policy. It’s a fight between Washington and the rest of America."
"What we have [is] a system in Washington where people get jobs if you're there, if you know someone and you work your way up, and it’s like musical chairs from one agency to another," Grenell added. "There is no outside thought, there's no outside perspective."
Grenell, who also spent two years as U.S. ambassador to Germany, characterized Trump as a great disruptor of this insular system.
"He's breaking their system," he said. "He doesn't play by the rules.
"I saw that at ODNI," Grenell added. "I saw that by entering the intelligence world, and senators from the Democratic Party saying, 'You have no experience, what are you doing — why should you be there?''"
Grenell specifically called out Sen. Mark Warner, D-Va., the top Democrat on the Senate Intelligence Committee, by noting that Grenell had received his first intelligence briefing back in 2001, before Warner was elected to public office.
"He said that I wasn’t qualified," Grennell said of Warner. "I actually am a receiver of intelligence, and [I'm] an expert on the consumer part of the intelligence and how to utilize it, but that perspective is never brought to Washington."

The Justice Department's (DOJ's) watchdog has identified critical errors in every FBI wiretap application that it audited as part of the fallout from the bureau's heavily flawed investigation into former Trump adviser Carter Page, who was surveilled during the campaign in part because of a largely discredited dossier funded by the Hillary Clinton campaign and the Democratic National Committee (DNC).
Additionally, an ex-FBI lawyer in that case even falsified a CIA email submitted to the Foreign Intelligence Surveillance Act (FISA) court in order to make Page's communications with Russians appear nefarious, the DOJ inspector general found. The FBI lawyer, Kevin Clinesmith, was allegedly told by the CIA that Page had reported his Russian contacts and was essentially acting as an informant -- only for Clinesmith to allegedly omit that exculpatory information in a surveillance warrant application that framed Page's communications with Russians as a sign that he was a secret foreign agent.
Barr said he couldn't comment on whether criminal charges were coming, including concerning Clinesmith -- but that people shouldn't become impatient. The DOJ has concluded that the Page warrant was legally improper and lacked probable cause.
"We can't discuss future charges. But I have to say that I do find a little irritating," Barr said. "You know, the propensity in the American public on all sides of the political spectrum when they see something they think could be a criminal violation, I say, why hasn't this person been indicted again? And, you know, there's the old saying that that the wheels of justice grind slow and they do run slow because we have due process and we follow the process. But people should not draw from the fact that no action has been taken that taken yet, that that means that people or people are going to get away with wrongdoing."

The Federal Rules of Criminal Procedure state that prosecutors may dismiss a case “with leave of court.” At issue in the Flynn case now is exactly what level of discretion this gives the court. Gleeson argues that it covers the current situation, claiming that federal prosecutors gave a pretext for why they want to drop the case.
“Facts surrounding the filing of the government’s motion constitute clear evidence of gross prosecutorial abuse,” Gleeson wrote in the filing. “They reveal an unconvincing effort to disguise as legitimate a decision to dismiss that is based solely on the fact that Flynn is a political ally of President Trump.”
“What's rich here is Judge Gleeson using the term ‘abuse of power,’” Jordan said in response. “Are you kidding me?”
He then pointed out that when Gleeson was still serving as a judge, he wrote in 2013 that prosecutors have "near-absolute power" to dismiss a case. He claimed that courts are "generally required" to grant a prosecutor’s motion to dismiss unless it is "clearly contrary to manifest public interest."
“Now he suddenly changed, which shows how political this is from his perspective and I think from Judge Sullivan’s perspective,” Jordan said.
He then noted a timeline of events, which he said shows Comey is an example of someone abusing power.
“Jan. 4, 2017, the FBI is going to drop the case against General Flynn and Jim Comey tells [former FBI agent] Peter Strzok, ‘Go tell the agents don't drop the case, we’re going to go after Flynn,’” Jordan said, adding that the “very next day” Comey “meets with President Obama and talks about the Michael Flynn case.”
